HRERA arrest warrants against two firms’ managements in decree cases

Gurugram, Dec 17 (MNN) The Haryana Real Estate Regulatory Authority here on Friday ordered arrest warrants against two real estate firms and asked them to show cause as to why they should not be sent to jail in two decree execution cases.

The Authority was hearing execution petitions, titled Satish Kumar Chawla vs Sepset Properties Private Limited and GS Datt vs Supertech Limited for execution of decrees passed against promoters namely Sepset Properties Private Limited and Supertech Limited.

The HRERA order was issued against Sepset Properties Private Limited Managing Director Adesh Kumar Tyagi and Supertech Limited Directors Ram Kishore Arora, Anil Kumar Jain, GL Khera, Anil Kumar Sharma, Mandeepa Joshi and Pradeep Kumar Goel (MD) for non-compliance of authority orders in decrees passed by it.

In Satish Kumar Chawla vs Sepset Properties Private Limited case, the Authority had earlier ordered attachment of bank account of judgment debtor with Indusland Bank, Barakhamba Road, New Delhi. However, despite receipt of notice and reminder, bank manager not only failed to comply with orders passes by the authority but also did not submit any report in this regard.

Taking serious note, HRERA directed issuance of show cause notice to the bank manager as to why proceedings for non-compliance of Authority order should not be initiated against him.

The manager was also directed to appear before the Authority for oral examination in case no reply to the warrants of attachments was given. The decree amount fixed in favour of decree holder through a demand draft within 15 days was also sought.

Despite several notices, the bank manager failed to appear, following which the Authority directed him to furnish a security of Rs 50,000 for his due appearance, or else in default he shall be committed to civil prison.

Further, the Authority had directed Sepset Properties Private Limited through its MD to submit a list of assets to satisfy the decree and also to produce books and documents with regard to assets of judgement debtor and file an affidavit with regard to its assets.

Despite receipt of notice, the promoter company’s MD failed to respond or put up an appearance before the Authority.

Haryana Real Estate Regulatory Authority led by Chairman KK Khandelwal on Friday directed that judgement debtor firm MD be arrested and brought before the Authority through Gurugram Commissioner of Police to show cause as to why he should not be sent to prison.

In GS Datt vs Supertech Limited case, against the promoter “Supertech Limited”, the Authority directed that the MD and Directors of judgment debtor be arrested and brought before the authority through Delhi Commissioner of Police and SHO(s) concerned of areas with registered office and residence of judgement debtor corporation is located.

“These decisions are very significant and will send across a clear message to all errant promoters who attempt to evade compliance of HRERA directions on one pretext or the other,” the Authority said.
